Terms & Conditions:

Failure to Perform:

If the photographer cannot perform this agreement due to fire or other casualty, strike, act of God or cause beyond the control of the parties, then the photographer shall return the booking fee to the client.
If the client decides to cancel this agreement, any monies paid with the exeption of the booking fee will be reinbursed.
Should the contracted photographer become sick or unable to perform with short notice of the event, Aztec Photography will offer to supply an alternative photographer for the event.

Agreement to Arbitrate:

The client and Aztec Photography agree to submit any dispute arising under this binding agreement in accordance with the Better Business Bureau. The arbitrator’s decision will be final and binding on both parties.
In the event the photographer shall not be liable for any amount in excess of the retail value of the client order.
Neither party will be able to go to court for disputes that must be arbitrated.

Digital Image Files:

The client images produced are high resolution JPG files, provided on DVDs.
If you require duplicate dvds, they can be purchased for $50 in a complete colletion.
A master copy of your dvds will remain on file for one (1) year from the date the event took place.
One (1) year after your event has taken place, you will become 100% responsible for your images as we may no longer have your master dvds on file.

Digital Copyright:

All Digital Negative (RAW) files are copyrighted by Aztec Photography, all rights reserved under Creative Commons.
Any images taken can be used for publicity purposes under the discretion of Aztec Photography without your prior consent.
If you wish to keep the rights to the Digital Negative (RAW) files, you may purchase the digital negatives of your event for $700.
The jpg digital images furnished to the client on the dvds shall be licensed under a Creative Commons Attribution 3.0 Unported License.
